Shirrts LLC - Terms of Use

Welcome to Shirrts.com. These Terms of Use ("Terms") govern your access to and use of the Shirrts website ("Site"), operated by Shirrts LLC ("Shirrts," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms.

1. USE OF OUR SERVICE

  • You may use Shirrts to design, preview, and purchase custom apparel.
  • You must be at least 13 years old to use this Site. If you are under 18, you must have a parent or guardian's permission.
  • You agree to use the Site only for lawful purposes and not to violate any applicable laws or regulations.
  • Abuse of the Site, including excessive automated content generation or disruptive activity that strains system resources, may result in suspension or termination of your access.

2. USER-GENERATED CONTENT

  • You retain ownership of content you create, but grant Shirrts a non-exclusive, royalty-free license to use, reproduce, and display it for purposes including fulfillment and promotion.
  • You are solely responsible for ensuring that your designs:
    • Do not infringe on any copyright, trademark, or other intellectual property rights.
    • Are not offensive, obscene, harassing, violent, inciting violence, or otherwise inappropriate.
    • Comply with all applicable laws.
  • You acknowledge that generative AI models may produce outputs that resemble third-party content, and you assume full responsibility for verifying the originality and legality of your design.
  • We do not claim ownership of AI-generated content, and we disclaim all liability for outputs that infringe on third-party rights.
  • We reserve the right to remove content or limit generation privileges at our sole discretion if abuse or policy violations are detected.
  • By using our platform, you acknowledge that design files (including mockups and high-resolution print files) generated or stored by Shirrts are not automatically made available for download or transfer. To produce physical items based on a design, users must place an order through Shirrts. We do not distribute or license raw design files.

3. INTELLECTUAL PROPERTY

  • The Shirrts name, logo, site design, and underlying software are owned by Shirrts LLC and protected by intellectual property laws.
  • You may not copy, distribute, modify, or reverse engineer any portion of our platform.

4. PAYMENT AND ORDERS

  • All prices are listed in U.S. dollars. Payment is due at the time of order.
  • Orders are final once placed. Because designs are custom-made, we do not offer returns except for defective or incorrect items.

5. ACCOUNTS

  • You may need to create an account to save designs or place orders.
  • You are responsible for maintaining the confidentiality of your login credentials.

6. DISCLAIMERS AND LIMITATION OF LIABILITY

  • Our service is provided "as is" without warranties of any kind.
  • We make no guarantees regarding the originality, legality, or fitness for purpose of AI-generated designs.
  • To the maximum extent permitted by law, Shirrts is not liable for any indirect, incidental, or consequential damages arising from your use of the Site, including claims related to AI-generated content.

7. DMCA AND COPYRIGHT POLICY

  • If you believe content on our Site infringes your copyright, you may submit a takedown notice to: legal@shirrts.com
  • Repeat infringers may have their accounts terminated.

8. TERMINATION

  • We may suspend or terminate your access to the Site at any time for any reason, including violation of these Terms.

9. GOVERNING LAW

  • These Terms are governed by the laws of the State of California without regard to its conflict of law principles.

10. CHANGES TO TERMS

  • We may update these Terms from time to time. The latest version will always be posted on this page.
